Offer Description

The research project aims at evaluating the impact on creative industries of the introduction by Italian copyright law of the principle of fair and proportionate remuneration of authors who assign or license their exclusive rights. To this end, it should focus on the provisions introduced by the Legislative Decree 8 November 2021, no.177, implementing Articles 18-21 of the CDSM Directive and assesses their positive and negative effects on the exploitation of exclusive rights and their market, taking into account the interpretative uncertainties they create, the impact of the future regulatory intervention of the Communications Authority, and the way how contractual practices may change in response to the legislative reform. The goal is to identify problems and difficulties, in order to propose, if necessary, reforms to correct the current transposition of the CDSM Directive.
