Among the “new goods” today, the intangible assets of the company are becoming increasingly important, including, in particular, data, information and their complex processing, which today are increasingly derived from big data. This phenomenon is defined as “cognitive capitalism”, meaning the transition from an economy based on the production of material goods to one based on processes aimed at the creation and circulation of information and knowledge. Increasingly efficient collection and archiving systems have favored the birth of the data economy. In the analysis of the civil law instruments of protection, particular attention must be paid to the opportunity to rely on the remedy framework before the ordinary courts and/or alternative justice bodies
