OFFER DESCRIPTION

1. Main activities :
- Realization of an exhaustive state of the art on the fundamental rights of children and adolescents (with rare diseases).
- Regulatory analysis (study in particular of conventions and legislation) and case law (national courts and tribunals, European courts) of the tensions between the optimization of care (the right to health) and respect for the fundamental rights of children and adolescents with rare disease (in the sense of the legal minority).
- Study on the ways in which the law is mobilized (in particular through legal recourse activities) by the legal representatives of patients ( in particular, children and adolescents suffering from rare diseases). Study of the effects of these remedies on healthcare and patients.
- Legal and socio-legal analysis and theory based on these studies.
- Participation in the final co-writing of the research report.

2. Secondary activities :
- Communications in international conferences
- Publications made with the coordinator of the research in international journals in English.

This will involve carrying out a regulatory and jurisprudential study (national courts and tribunals, European courts) of the tensions between the optimization of care (the right to health) and respect for the fundamental rights of children and adolescents suffering from a rare disease (in the sense of legal minority). It will also be a question of carrying out a study on the ways in which the law is mobilized and used (in particular bylodging complaints with courts) by the legal representatives of children and adolescents suffering from rare diseases.
It is also about promoting the results of the survey by means of communications at conferences and publications in international journals in English.

The Law and Social Change laboratory is located in Nantes (on the small port university campus at the Faculty of Law) and is made up of a Director, a Deputy Director, a Management Committee, a Board of Laboratory and an administrative center.
The research unit is made up of PhD students, teacher-researchers, CNRS researchers, and CNRS engineers. DCS analyzes the role of the legal phenomenon in the transformations of contemporary society. DCS's research themes are Political and Legal Europe, Globalization Local governance and Relocation Processes, Technological Innovations, Health and Biopower Justice (s), norms, practices and societies Human, Social and Professional Mobility, Legal and Interdisciplinary Reflexivities.
The recruit will work within the Justice (s) scientific axis, as well as within the health axis, under the responsibility of the project manager and deputy director of DCS.

Eligibility criteria

The candidat will have a PhD in law.
- Legal (technical) skills for analyzing international and regional conventions: very good knowledge expected.
- (technical) skills in analyzing remedies and their effects: very good degree of mastery expected.
- Analytical and theorizing skills (techniques): good degree of mastery expected.
- Ability (techniques) of oral expression and writing of scientific reports and articles. Good degree of proficiency expected.
- Seriousness and assiduity in the work (knowing how to be, soft skills)
