The research aims to examine the issue of negotiating the management of private disputes in the roman legal experience, with particular reference to the classical period. For this reason the pre-trial and trial agreements in the roman civil jurisdiction aimed at resolving the dispute without reaching a sentence will be analyzed. Given the biphasic nature of the civil trial in the classical period, particular attention will be paid to the interventions of both the jurisdictional body, especially the magistrate, and the private judge in charge of the dispute; the innovative aspects of these remedies in the cognitio extra ordinem procedure will also be evaluated. Finally, the roman experience as a possible model for eventual improvements of the current alternative dispute resolution techniques will be considered.
